Terms of Intermediation & Sale

The offer for the sale of movable goods on the Montriva platform is made by the seller and not by the website owner. Therefore, when purchasing a product, the contract is concluded directly between the buyer and the seller. The website owner is not a party to this sales contract.

The terms applicable between the seller and the buyer are included in this document solely for transparency and user convenience.

Note: These terms and conditions apply exclusively between the buyer and the seller and cannot be invoked against the website owner.

If the seller is established in a country within the European Union (EU), Norway, Liechtenstein, or Iceland, the European Distance Selling Directive applies. This directive provides the following rights and guarantees:

  • The seller must provide the buyer with clear written information regarding taxes, payment terms, delivery, and execution of the contract.
  • The buyer must receive their order within 30 days unless otherwise agreed.
  • If the product is unavailable, the seller must inform the buyer. All payments must be refunded within 30 days unless an equivalent product is provided.
  • The buyer has the right of withdrawal, allowing the return of the product within 14 days without giving any reason. Shipping costs are the responsibility of the buyer. Refunds must be issued within 30 days.

ARTICLE 1 – DEFINITIONS

For the purposes of these intermediation terms, the following definitions apply:

  • Website: The platform accessible at montriva.dk, including all associated subdomains.
  • Website Owner: Chamber of Commerce upon request.
  • Buyer: The person making a purchase on the website.
  • Seller: The company selling movable goods to the buyer, acting as a manufacturer or distributor.

ARTICLE 2 – BUYER RIGHTS

If the seller is located in the EU, Norway, Liechtenstein, or Iceland, the European Distance Selling Directive applies and provides the following:

  • The seller must provide clear written information regarding taxes, payments, delivery, and contract execution.
  • The buyer receives the order within 30 days unless otherwise agreed. If unavailable, the seller must inform the buyer and issue a refund within 30 days (unless an equivalent product is provided).
  • The buyer has the right to withdraw from the contract within 14 days without stating a reason. Return shipping costs are borne by the buyer. Refunds must be issued within 30 days.

ARTICLE 3 – TYPES OF INTERMEDIATION SERVICES

The offer for the sale of goods on the Montriva platform is made by the seller, not the website owner. Therefore, the sales contract is concluded directly between the buyer and the seller. The website owner is not a party to this contract.

Some goods are purchased via the website from third parties, who may or may not be established within the European Union.

The service provided by the website owner consists of commercial intermediation on behalf of third parties. By placing an order on the website, the website owner is authorized to act as an intermediary on behalf of the buyer to place the order with the actual seller of the product.

If the actual seller is located outside Australia and the product must be imported, this import is carried out in the name of the buyer. Any additional costs, such as import VAT, customs duties, or clearance fees, are the responsibility of the buyer.

ARTICLE 4 – PAYMENT

Payment for the purchased product is made through the website owner. The website owner is also responsible for transferring the payment (or re-payment) to the actual seller.

The prices displayed on the website may differ from the amounts paid by the website owner to the actual seller. The difference between the amount paid by the buyer and the amount transferred to the seller constitutes compensation for the intermediation service provided by the website owner.
